The following General Conditions regulate the use (including mere access) of the web pages which are part of the GALENICUM website, including the contents and services made available therein (the "GALENICUM Site"). Any person who has access to the GALENICUM Site (the "User") hereby accepts the General Conditions which shall be in force each time the GALENICUM Site is visited.

The contents and services that GALENICUM makes available to User in the GALENICUM Site (hereinafter referred to as the "Contents" and the "Services", respectively) may likewise be regulated by special conditions which shall prevail over the General Conditions in the event of a discrepancy (the "Special Conditions"). User likewise accepts the application of the relevant Special Conditions each time the corresponding Content of Service is used.

Consequently, User must read the General Conditions carefully each time he/she intends to use the GALENICUM Site and the corresponding Special Conditions, each time he/she intends to use the relevant Content or Service. In any event, GALENICUM reserves the right to modify at any time and without prior notice, the appearance and structure of the GALENICUM Site, as well as the General Conditions and/or the relevant Special Conditions.

Use of the GALENICUM Site

Except as otherwise provided in the Special Conditions, the use of the GALENICUM Site will be free of charge, notwithstanding the connection charge paid by the User to gain access through the relevant telecommunications network.

User acknowledges and voluntarily and expressly accepts, that the use of the GALENICUM Site is made under his/her sole and exclusive responsibility at all times.

While making use of the GALENICUM Site, the User agrees not to perform any act that could: (i) infringe the law and/or the General Conditions or (ii) damage the image, the interests or rights of GALENICUM or third parties or which could damage, disable or overload the Website, or which may impede or alter in any way, the normal use of the Website. In particular, the User expressly agrees not to: (i) destroy, alter, disable or otherwise, damage electronic data, programmess or documents and other information that can be found on the Website; and (ii) introduce programmess, viruses, macros, controls or any other logic device or sequence of characters that cause, or are likely to cause, any alteration to the computer systems of the Website or of third parties.

GALENICUM implements reasonable security measures which are adequate to detect the existence of viruses. Nevertheless, User must be aware that the existing security measures for computer systems on the Internet are not entirely trustworthy and that GALENICUM therefore cannot guarantee the non-existence of viruses, malicious software, worms, social engineering attacks by third parties (phishing, pharming, trojans, etc.) or any other elements that may cause alterations to the User's computer systems (hardware and software) or to his/her electronic documents and files contained in the systems.

It is prohibited to access the Website through mechanised systems rather than individuals, as this causes damage to GALENICUM since GALENICUM is unable to objectively measure the audience.

GALENICUM excludes all liability arising beyond GALENICUM's control for: (i) interferences, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operation of the electronic system; or (ii) delays or blockages in the operation of the electronic system caused by deficiencies or overloads of telephone lines or the Internet, as well as damage caused by third parties.

GALENICUM is authorised to temporarily suspend, without prior notice, access to the Website due to maintenance, repair, update or improvement tasks.

The Contents of the GALENICUM Site are made available to the User by GALENICUM with information taken from its own and from third party sources.

GALENICUM tries to ensure that the Contents are of the best possible quality and reasonably updated, however, GALENICUM does not guarantee the usefulness, precision, completeness or relevance of the Contents and/or whether such Contents are up-to-date.

Industrial and Intellectual property rights

All Content (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any other elements which appear on the Website), unless otherwise indicated, are exclusively owned by GALENICUM or by third parties.

As regards the Content, GALENICUM does not accept any responsibility for its accuracy or veracity or for its wrongful use.

The General Conditions herein contained shall not be construed as to assign any industrial or intellectual property rights over the GALENICUM Site or over any of the parts thereof. User is expressly prohibited from carrying out any reproduction, transformation, distribution, public communication, making available, extraction, reusing, resending or in any way using, by means or procedure, any of the parts of the GALENICUM Site, except when it is lawful to do so or authorisation has been provided by the holder of the relevant rights.

User may visualise and obtain a temporary private copy of the Contents for exclusive and personal use in his/her computer systems (hardware and software), provided that the intended use is not to perform any commercial or professional activity. User must refrain from obtaining or attempting to obtain, the Contents by means or procedures other than those which have been made available to him/her or indicated for that purpose, or which are normally used on the Internet (provided that the latter do not imply a risk of damage or uselessness for the GALENICUM Site). User shall at all times respect the industrial and intellectual property rights existing over the GALENICUM Site, whether owned by GALENICUM or by third parties.

The holder of the personal data may, at any time, contact GALENICUM in writing in order to exercise its rights of access, rectification, cancellation and opposition of the processing of its personal data carried out by GALENICUM, indicating "ARCO Rights" in the subject and certifying its identity.

Governing law and jurisdiction

These General Conditions are governed by Spanish Law. GALENICUM and the User hereby expressly waive any other jurisdiction that may apply to them by Law and agree to abide by the Courts of the User's domicile for any dispute that may arise from the rendering of services covered by these General Conditions. If the User's domicile is outside Spain, GALENICUM and the User agree to abide by the Courts of Barcelona (Spain), expressly waiving any other jurisdiction.
